Land Related Laws Reform

Work commenced in March, 2003. The Commission was mandated to formulate a new legislative frame work for land matters which would articulate the principals contained in the National Land Policy adopted by Government in January, 2002.

 

Pursuant to this mandate, the Commission has recommended a numerous reforms which include the following:

  • Land is to be categorized into two: Private and public land. The two categories are to have classes as follows: private land to constitute leaseholds, freeholds and customary estates; public land to constitute of Government land and unallocated land within a traditional management area
  • Land administration should be decentralized and powers conferred on the Minister, local authorities and Traditional authorities
  • Proposal to introduce a new legal framework to regulate the administration of customary land, the new law to be titled "Customary Land Management Act"
