Notice of 2009 Work Programme

The Law Commission in accordance with section 7(1) (a) of Law Commission Act, 1998 and in pursuance of its powers and functions under the Act and the Constitution, hereby publishes its programme of work for the year 2009.


Law Reform Programmes

  1. On-going Programmes
    1. Trafficking in Persons: The special Law Commission on the development of legislation to combat trafficking in persons will finalize the programme and will publish a Report of its findings and recommendations, which shall be submitted to Ministry of Justice.
    2. Gender-related Law Reforms: The special Law Commission on Gender Related Law Reforms will finalize the third and final phase of the programme, which is the development of gender equality legislation and will publish a Report of its findings and recommendations, which shall be submitted to Ministry of Justice
    3. Review of Legal Education and Legal Practitioners Act, Cap. 3:04 Laws of Malawi: The special Law Commission on the Review of the Legal Education and Legal Practitioners Act, Cap. 3:04, Laws of Malawi will finalize the programme and will publish a Report of its findings and recommendations, which shall be submitted to Ministry of Justice
    4. Review of the Education Act, Cap. 30:01, Laws of Malawi: The special Law Commission on the Review of the Education Act, Cap. 30:01 Laws of Malawi will finalize the programme and will publish a Report of its findings and recommendations, which shall be submitted to Ministry of Justice
  2. New Programmes
    1. Review of Intellectual Property Rights Laws: The Law Commissioner, in consultation with the Judicial Service Commission, shall empanel a special Law Commission to review intellectual property rights laws. The programme will be in three phases and the first phase is on Trade Marks
    2. Review of the Witchcraft Act, Cap. 7:02, Laws of Malawi: The Law Commissioner, in consultation with the Judicial Service Commission, shall empanel a special Law Commission to review the Witchcraft Act, Cap.7:02, Laws of Malawi
    3. Review of the Firearms Act, Cap. 14:08, Laws of Malawi; and Explosives Act, Cap. 14:09, Laws of Malawi: The Law Commissioner, in consultation with the Judicial Service Commission, shall empanel a special Law Commission to review the Firearms Act, Cap.14:08, Laws of Malawi and the Explosives Act, Cap. 14:09, Laws of Malawi
    4. Review of the Chiefs Act, Cap. 22:03, Laws of Malawi: The Law Commission shall carry out research to determine the necessity of reviewing the Chiefs Act, Cap. 22:03, Laws of Malawi
    5. Review of the Adoption of Children Act, Cap. 26:01, Laws of Malawi: The Law Commissioner, in consultation with the Judicial Service Commission shall empanel a special Law Commission to review the Adoption of Children Act, Cap. 26:01, Laws of Malawi
    6. Review of the Prevention of Domestic Violence Act, No. 5 of 2006: The Law Commissioner, in consultation with the Judicial Service Commission, shall empanel a special Law Commission to review the Prevention of Domestic Violence Act No.5 of 2006

Publications
The Law Commission shall publish Discussion and/or Issues Papers on the following:

  1. Review of the Intellectual Property Rights Laws
  2. Review of the Adoption of Children Act, Cap. 26:01, Laws of Malawi
  3. Review of the Chiefs Act, Cap. 22:03, Laws of Malawi
  4. Review of the Firearms Act, Cap. 14:08, Laws of Malawi and Other Explosives Act, Cap. 14:09, Laws of Malawi, and
  5. Review of the Witchcraft Act, Cap. 7:02, Laws of Malawi

The Law Commission shall also published Reports on the following law reform programmes-

  1. Gender Equality
  2. Review of the Education Act; Cap. 30:01, Laws of Malawi
  3. Review of the Legal Education and Legal Practitioners Act, Cap 3:04
  4. Trafficking in Persons, and
  5. Review of Land Related Laws

Other Activities

  1. Public Awareness and Civic Education
  2. The Law Commission shall continue executing its mandate of promoting awareness of laws in Malawi by the public, government departments and other authorities or bodies

The Law Commission shall also continue carrying out civic education activities on its completed and on-going law reform programmes
